This website, accessible notably at driftparc.com, is operated by DriftParc. In these terms, the terms “DriftParc,” “we,” “us,” and “our” refer to the operator of the DriftParc store.

By accessing our website, creating an account, placing an order, or using our services, you agree to these Terms of Use and Terms of Sale, as well as the policies and terms incorporated herein by reference.

Certain activities, products, promotions, and contests may be subject to additional terms. In the event of a conflict relating to a particular activity, the specific terms applicable to that activity will prevail.

2. USE OF THE WEBSITE

You may use the website only for lawful purposes.

It is prohibited, among other things, to:

  • use the website for fraudulent or unlawful purposes;
  • attempt to gain unauthorized access to the website, its systems, or other users' accounts;
  • disrupt the operation or security of the website;
  • use bots, scripts, or other automated systems for the purpose of abusing our services, promotions, or contests;
  • transmit malicious content, viruses, or any other harmful code;
  • attempt to manipulate an order, promotion, contest, or entry system.

We may restrict access to the website where abusive or fraudulent use, or use that may compromise the security of our systems, is detected.

3. CAPACITY TO CONTRACT

By making a purchase, you confirm that you have the legal capacity to enter into the applicable contract.

If you are a minor or do not have the required full legal capacity, your purchase must be made with the authorization of your parent or legal guardian where such authorization is required.

The age and eligibility requirements applicable to a contest are determined exclusively by the Official Rules of that contest.

4. PRODUCTS AND SERVICES

DriftParc may offer, among other things:

  • clothing and accessories;
  • made-to-order merchandise;
  • automotive parts;
  • automotive performance products and services;
  • programming or electronic calibration services;
  • digital products;
  • Supporter Packs;
  • experiences associated with the DriftParc team;
  • promotions and other products or services that may be added to the store.

The features, inclusions, restrictions, prices, and specific terms of a product are indicated on its product page at the time of purchase.

We make reasonable efforts to present products accurately. Minor differences in color, dimensions, print placement, finish, or appearance may nevertheless exist between photographs displayed on screen and the product delivered.

5. PRICES AND CURRENCY

Unless otherwise indicated, prices displayed on driftparc.com are in Canadian dollars.

Applicable taxes, shipping charges, and other known fees are displayed in accordance with the information available at the time of the order and before final confirmation of the order.

The applicable total price is the amount presented to the customer before confirmation of the purchase, subject to rights provided by applicable laws.

6. ORDERS

When you place an order, you must provide accurate, complete, and current information.

Receipt of an automated confirmation does not necessarily mean that an order has already been prepared or shipped.

An order may be refused or cancelled where there is a legitimate reason to do so, including in cases of:

  • reasonable suspicion of fraud;
  • declined or unauthorized payment;
  • abusive use of the website;
  • actual inability to fulfill the order;
  • an order that violates these terms;
  • legal restrictions applicable to the product or customer.

Any cancellation or modification remains subject to applicable consumer protection laws.

When a paid order is cancelled by DriftParc and no product or service has been provided, the applicable amounts will be refunded in accordance with the law.

7. PAYMENTS

Payments are processed using the payment methods offered at checkout.

DriftParc may use third-party providers to process payments. Payment information may therefore be processed directly by these providers in accordance with their own security and privacy obligations.

You confirm that you are authorized to use the payment method provided for the transaction.

8. DELIVERY OF PHYSICAL PRODUCTS

Processing and delivery times may vary depending on the product, its availability, manufacturing method, destination, and provider used.

Certain DriftParc products are manufactured or shipped by external partners or print-on-demand services.

Displayed delivery times are estimates where the exact delivery date depends on a carrier or external provider.

Information regarding delivery, applicable fees, and known restrictions is presented when ordering or in our Shipping Policy.

Consumer rights provided by law with respect to delivery remain fully applicable.

9. MADE-TO-ORDER PRODUCTS

Certain clothing, accessories, prints, and other products may be manufactured specifically after an order is received.

Made-to-order production may result in minor variations between individual units, including variations in:

  • print placement;
  • print dimensions;
  • color;
  • finish;
  • design placement.

These normal manufacturing variations do not necessarily constitute a defect.

Products with a manufacturing defect, an order error, or an issue covered by applicable legal protections remain subject to our Refund Policy and applicable laws.

10. DIGITAL PRODUCTS

Certain products include digital files, including wallpapers, digital posters, certificates, or other downloadable content.

The delivery method and timeframe are indicated on the product page. Certain content may be delivered automatically after the order, while other content may require preparation for up to the timeframe indicated at the time of purchase.

The customer is responsible for providing a valid email address.

Digital products are intended for personal use unless otherwise authorized in writing.

It is prohibited to:

  • resell the files;
  • redistribute them;
  • make them publicly available;
  • include them in another product intended for sale;
  • remove or circumvent any technical protection that may be used.

The purchase of a digital product does not transfer any intellectual property rights in its content.

Any restriction relating to refunds for a digital product applies only to the extent permitted by law.

11. DRIFTPARC SUPPORTER PACKS

DriftParc may offer different Supporter Packs that allow members of the community to support the team's activities while receiving the products or benefits described in the purchased pack.

A Supporter Pack constitutes a commercial transaction for the goods, digital content, benefits, or experiences identified on its product page.

The purchase of a Supporter Pack:

  • does not constitute a charitable donation;
  • does not entitle the customer to a charitable donation tax receipt;
  • does not constitute an investment in DriftParc;
  • does not provide any ownership interest in the company;
  • does not guarantee any financial return;
  • does not create an employment, business association, or partnership relationship between the customer and DriftParc.

Each Supporter Pack level includes only the items described on its product page at the time of purchase.

12. PUBLIC RECOGNITION OF SUPPORTERS

Certain Supporter Packs may include displaying the customer's name on a thank-you page or another section of the DriftParc website.

The customer may be asked to provide the name they wish to have displayed.

DriftParc may refuse or remove a name, nickname, or text containing, among other things:

  • hateful content;
  • sexually explicit content;
  • threats;
  • harassment;
  • impersonation;
  • a trademark used without authorization;
  • illegal or clearly inappropriate content.

Where possible, the customer may provide another acceptable name.

13. PHOTOGRAPHS AT EVENTS

Certain Supporter Packs may include professional photographs with the DriftParc vehicle and driver during an event or competition.

The ability to take these photographs depends on factors including:

  • access to the location;
  • the organizer's rules;
  • the competition schedule;
  • availability of the driver and vehicle;
  • safety conditions;
  • weather conditions;
  • mechanical or operational circumstances.

The customer remains responsible for transportation, accommodation, admission tickets, and other personal expenses unless an item is expressly stated to be included.

Where the activity cannot reasonably take place on the originally planned date, DriftParc may offer another reasonable opportunity to provide the purchased benefit.

14. PASSENGER DRIFT CAR EXPERIENCE

Certain Supporter Packs may include an experience as a passenger in a drift vehicle driven by Pier-Luc Lavoie or by a driver designated by DriftParc.

This activity involves a competition vehicle and carries risks inherent to motorsports.

Availability

Experiences are organized on certain dates determined by DriftParc.

DriftParc expects to select at least two opportunities during the summer season when this service is offered, subject to the availability of the vehicle, facilities, and events.

Dates may be modified for reasons including:

  • a competition;
  • a change to the motorsports schedule;
  • a mechanical failure;
  • a repair;
  • an inspection;
  • weather conditions;
  • unsuitable track conditions;
  • a requirement imposed by the organizer;
  • a situation that compromises the safety of participants or the vehicle.

Safety and the team's ability to participate in its competition activities remain the priority.

Participation Requirements

Participation may be conditional upon, among other things:

  • following the instructions of the driver and staff;
  • complying with track or event rules;
  • wearing the required safety equipment;
  • proper use of restraint systems;
  • having the physical ability to enter the vehicle and use the safety equipment;
  • signing forms or releases reasonably required by the track, organizer, or DriftParc, to the extent permitted by law.

A person may be refused participation in an activity where their participation objectively presents a risk to their own safety or the safety of others.

Consumption of alcohol, cannabis, drugs, or any condition that may compromise safety may result in refusal to participate in the activity.

Risks

The participant acknowledges that motorsports involve inherent risks, including acceleration, braking, significant lateral movement, noise, vibration, and the possibility of mechanical incidents or leaving the track.

Nothing in these terms is intended to exclude or limit liability that cannot legally be excluded or limited.

15. AUTOMOTIVE PARTS AND PERFORMANCE PRODUCTS

Automotive performance parts must be used for their intended purpose and installed correctly.

The customer is responsible for verifying the compatibility of the product with their vehicle before installation.

Where specific mechanical expertise is required, DriftParc recommends that installation be performed by a qualified person.

Modifying a vehicle may have consequences for:

  • its handling;
  • its safety;
  • its certification or approval;
  • its warranty;
  • its insurance;
  • its compliance with road, environmental, or other regulatory standards.

It is the vehicle owner's responsibility to ensure that any modifications made comply with applicable laws and regulations.

Applicable legal warranties for products are not limited by this section.

16. ECU PROGRAMMING, CALIBRATION, AND TUNING

Certain products or services offered by DriftParc or its partners relate to the programming or calibration of vehicle electronic systems.

Where a product page specifies that a product is intended exclusively for off-road, competition, or closed-course use, the customer agrees to comply with that restriction.

The customer remains responsible for verifying the laws and regulations applicable to the use of their vehicle.

An electronic modification may affect, among other things:

  • vehicle performance;
  • emissions;
  • fuel consumption;
  • certain electronic functions;
  • the manufacturer's warranty;
  • the vehicle's compliance for road use.

The customer must provide accurate information regarding their vehicle, including the model, year, engine, existing modifications, and, where requested, the VIN.

DriftParc is not responsible for a problem resulting directly from inaccurate information provided by the customer, improper installation, or use contrary to the instructions provided, subject to liabilities that cannot be excluded by law.

17. CONTESTS, DRAWS, AND PROMOTIONS

DriftParc may organize contests, draws, or promotions.

Each contest is subject to its own Official Rules, available on the contest page or at the location indicated in the promotion.

The Official Rules determine, among other things:

  • the contest dates;
  • the eligible territory;
  • age requirements;
  • methods of entry;
  • no-purchase methods of entry where applicable;
  • the number of entries awarded;
  • the prizes;
  • their approximate value;
  • the winner selection process;
  • the skill-testing question where required;
  • claim deadlines;
  • other conditions for awarding prizes.

In the event of a conflict between these Terms of Use and the Official Rules of a contest, the Official Rules of the contest will prevail with respect to any matter concerning that contest.

18. ENTRIES ASSOCIATED WITH PURCHASES

During certain promotional periods, an eligible purchase may generate entries in a contest.

The number of entries and calculation method are determined by the applicable Official Rules.

Entries:

  • do not constitute property with independent monetary value;
  • may not be sold or transferred unless otherwise stated in the rules;
  • do not constitute a guarantee of winning;
  • do not replace the goods or services purchased.

When an order is cancelled, refunded, returned, or subject to a chargeback, entries awarded in connection with the cancelled or refunded amount may also be cancelled in accordance with the Official Rules and applicable laws.

Any free method of entry provided by the Official Rules is independent of a purchase.

19. NO GUARANTEE OF WINNING

Purchasing a product or Supporter Pack does not guarantee any prize in a contest.

Where entries are awarded with a purchase, the customer is first purchasing the product, service, content, or Supporter Pack described on the product page.

Participation in the contest is a separate promotional benefit whose terms are established in the Official Rules.

20. CONTEST FRAUD AND ABUSE

DriftParc may investigate any reasonably suspected attempt involving:

  • automated creation of entries;
  • use of fictitious identities;
  • transaction manipulation;
  • payment fraud;
  • abusive chargebacks;
  • falsification of proof of entry;
  • circumvention of limits established by the rules;
  • technical manipulation of the contest system.

Fraudulent or non-compliant entries may be cancelled in accordance with the Official Rules and the law.

21. RETURNS, CANCELLATIONS, AND REFUNDS

General terms regarding returns, exchanges, and refunds are described in our Refund Policy.

Certain product categories may be subject to specific terms indicated on their product pages.

Nothing in our Refund Policy or these Terms limits the rights granted to consumers under applicable laws.

Where the conditions provided by the Consumer Protection Act or another applicable law permit cancellation or refund of a transaction, those rights remain applicable.

22. LEGAL WARRANTIES

Goods and services sold to consumers may be covered by the legal warranties provided under the Consumer Protection Act and the Civil Code of Québec.

These warranties apply independently of any additional warranty that may be offered by DriftParc, a manufacturer, or a supplier.

Nothing in these Terms is intended to eliminate, reduce, or replace a mandatory legal warranty.

23. THIRD-PARTY PROVIDERS AND SERVICES

DriftParc uses various providers and partners to operate the store, including for:

  • store hosting;
  • payment processing;
  • manufacturing of certain products;
  • print-on-demand services;
  • shipping;
  • certain technical services;
  • certain events.

The use of a third-party provider does not modify the rights granted to consumers by law against DriftParc where DriftParc acts as the merchant in the transaction.

Certain external services may also be subject to the providers' own terms.

24. INTELLECTUAL PROPERTY

Unless otherwise indicated, the text, photographs, videos, drawings, graphics, logos, trademarks, visual elements, digital files, and other content published on driftparc.com are the property of DriftParc, their respective authors, or partners who have authorized their use.

No content may be reproduced, redistributed, sold, commercially exploited, or used without authorization where such authorization is required.

Purchasing a product containing an image, trademark, or design does not transfer any intellectual property rights to the customer.

25. PHOTOGRAPHS, VIDEOS, AND EVENTS

Photographs and videos may be taken at DriftParc events or events in which DriftParc participates.

The rules governing the use of a person's image are determined by applicable laws and, where applicable, by authorizations obtained for a particular activity.

Participation in a public event does not automatically constitute a general waiver of all rights relating to a person's image.

26. ACCURACY OF CONTENT

DriftParc attempts to keep the information on the website up to date.

However, typographical, technical, or descriptive errors may occasionally appear.

When we discover an error, we may correct it.

Any correction relating to a transaction that has already been concluded will be made in accordance with legal obligations.

27. WEBSITE AVAILABILITY

We may modify, suspend, or temporarily interrupt certain website features, including for:

  • maintenance;
  • security;
  • updates;
  • a provider failure;
  • a situation beyond our control.

We do not guarantee that the website will be available without interruption at all times.

28. EXTERNAL LINKS AND SERVICES

The website may contain links to external platforms, including social networks, payment platforms, suppliers, partners, or event organizers.

DriftParc does not necessarily exercise control over the content or policies of these platforms.

Use of an external service may be subject to that provider's own terms.

29. PRIVACY AND PERSONAL INFORMATION

The collection, use, retention, and disclosure of personal information are described in our Privacy Policy.

By using the website or placing an order, you acknowledge that you have access to this policy.

Enrollment in marketing communications is managed separately where consent is required.

Entering a contest or purchasing a product does not automatically constitute unlimited consent to receive promotional communications where the law requires separate consent.

30. ORDER AND CONTEST COMMUNICATIONS

DriftParc may communicate with you where necessary to administer:

  • your order;
  • a delivery;
  • a refund;
  • a digital product;
  • an experience;
  • your participation in a contest;
  • a prize claim;
  • a security or fraud matter.

These transactional or administrative communications are separate from marketing communications.

31. LIMITATION OF LIABILITY

To the extent permitted by law, DriftParc cannot be held liable for damages resulting exclusively from:

  • use of a product contrary to instructions;
  • an unauthorized modification of the product;
  • improper installation performed by the customer or a third party;
  • inaccurate information provided by the customer;
  • an external event reasonably beyond its control.

Nothing in these Terms is intended to exclude or limit:

  • legal warranties;
  • rights provided under the Consumer Protection Act;
  • liability that cannot legally be excluded or limited;
  • any other mandatory protection applicable to consumers.

32. FORCE MAJEURE AND EVENTS BEYOND OUR CONTROL

Certain services or activities may be affected by events reasonably beyond DriftParc's control, including:

  • significant weather conditions;
  • track closure;
  • event cancellation;
  • major outage;
  • accident;
  • mechanical failure;
  • carrier service interruption;
  • natural disaster;
  • government action;
  • an urgent situation affecting safety.

In these situations, DriftParc will attempt to offer a reasonable solution based on the nature of the applicable obligation and the rights provided by law.

33. CHANGES TO THESE TERMS

DriftParc may modify these Terms to reflect, among other things:

  • changes to its products or services;
  • technological changes;
  • legislative changes;
  • new activities;
  • new safety requirements.

The version applicable to a transaction is generally the version that was available when that transaction was concluded, subject to applicable laws.

The date of the latest update is displayed at the beginning of the document.

34. SEVERABILITY

If any provision of these Terms is declared invalid or unenforceable, that provision will be interpreted or limited to the extent necessary without invalidating the remaining provisions where permitted by law.

35. NO WAIVER OF CONSUMER RIGHTS

Nothing in these Terms shall be interpreted as a waiver of any right that a consumer cannot legally waive.

In the event of a conflict between these Terms and a mandatory provision of applicable law, the applicable legal provision will prevail.

36. GOVERNING LAW

These Terms are governed by the laws applicable in the Province of Quebec and the federal laws of Canada applicable therein.

Any dispute is subject to the courts having jurisdiction as determined in accordance with applicable mandatory rules.

The following documents form part of the contractual framework of the store where their content is applicable:

In the event of a conflict concerning a specific product, service, or contest, the applicable specific terms are interpreted together with these Terms, subject to applicable laws.
